Blaming CJI ‘prejudiced’ BCCI appealed for review on Lodha recommendation verdict

Internet Desk: BCCI further moved to the Supreme Court to appeal for the review of the verdict the apex court made on the Lodha Committee recommendation. They made this appeal specially to be reviewed by a five-judge Constitution Bench, as they think that the two judge bench of Justice T S Thakur and FM Ibrahim were ‘prejudiced’.

On Tuesday the board pleaded for an open court hearing and recusal of the CJI, alleging that Thakur “seems to have a prejudiced approach” against the BCCI. BCCI sources alleged the CJI is biased because he mocked at the board during the hearing.

The review petition made on the verdict of 18th July follows legal advice rendered by former Supreme Court judge Justice Markandey Katju in his interim report to the Board that the verdict smacked of judicial overreach and was thus unconstitutional.

Review petitions are not heard in open court and decided by a practice called “hearing by circulation” in which advocates are not allowed to present arguments.

The petition follows Justice Katju’s advice that the Supreme Court plainly ignored the law that any change in the rules of the BCCI should have been made through a special resolution initiated under the Tamil Nadu Societies Registration Act.
